Terms of Service

[Special Notice] This Agreement constitutes a legal contract between you and OceanCloud along with its official e-commerce platform OceanMart (collectively, "the Company"). By completing a purchase, clicking to buy, or utilizing the services, you acknowledge that you have fully understood and voluntarily accepted all terms herein.

1. Service Definition and Business Scope

1.1 OceanCloud is a global technology brand responsible for infrastructure maintenance and high-quality network data communication services.

1.2 OceanMart (oceancloud.asia) is the designated official distributor, providing Emby Media Library licenses, value-added subscription plans, and related digital products, including automated delivery and primary technical support.

2. User Conduct and Compliance

Users must strictly comply with all applicable laws while using our services. The following rules are established for regulatory compliance:

[Jurisdictional Restrictions & Compliance] In respect of global cybersecurity policies, our infrastructure and licenses do not cover mainland China, Iran, or other regions with specific network restrictive policies. The Company does not actively promote or provide direct access services in these regions. Users must ensure their usage complies with local laws; any legal risks or liabilities arising from the user's disregard for local regulations shall be borne solely by the user.
[Resale Prohibited] It is strictly forbidden to resell, mark up, or publicly share any Emby licenses or subscriptions purchased from this platform.
[Content Redline] Using our services to transmit or store politically sensitive, pornographic, violent, or copyright-infringing information is strictly prohibited.
[Security Obligation] Users are responsible for their credentials. The Company is not liable for bans or losses caused by account sharing or credential leaks by the user.

3. Digital Goods Non-Refundable Policy

IMPORTANT: Products sold by OceanCloud/OceanMart (e.g., Subscriptions, Emby Licenses) are "instant and irreversible" digital services. Once the system completes delivery, the digital rights are activated and cannot be reclaimed. Therefore, except for permanent service failure caused by our technical issues, all sales are final—no refunds, credits, or exchanges. Purchase constitutes consent to this policy.

4. Service Stability and Disclaimer

4.1 We strive for 99.9% uptime. However, due to the complexity of the internet, we are not liable for latency or temporary access restrictions caused by backbone network fluctuations, government interventions, or upstream provider failures.

4.2 The Company acts as a technical provider. Users are solely responsible for their actions. If illegal usage leads to regulatory investigation, we will comply with legal requests and terminate services immediately.

5. Termination and Penalties

For violations (e.g., multi-IP logins, malicious attacks, unauthorized resale), the Company reserves the right to terminate services permanently without prior notice. No refunds will be provided, and we reserve the right to report to relevant authorities.

6. Privacy and Terms Amendment

We respect user privacy; data is only used for service optimization and never shared with third parties. We reserve the right to amend these terms, and updates are effective upon publication. This agreement has the same legal effect as a signed electronic contract.

【特别提示】 本协议为您与 云海互联 及其官方电子商务平台 云海Mart（以下合称“本公司”）之间订立的法律契约。当您在云海互联以及云海Mart完成支付、点击购买或实际使用服务时，即视为您已完全知悉并自愿接受本协议之全部内容。

1. 服务定义与业务范畴

1.1 云海互联 (OceanCloud) 为面向全球用户的技术品牌，致力于提供底层框架维护与高质量的网络数据通信保障服务。

1.2 云海Mart (oceancloud.asia) 为本公司唯一指定官方分销商平台，提供 Emby 媒体库授权码、增值订阅计划及相关数字化产品的销售、订单自动化交付与初级技术支持。

2. 用户行为准则与合规声明

用户在使用本公司提供的流媒体授权或网络服务时，须严格遵守法律法规。基于法律合规与规范运营之要求，我们制定了如下准则：

【区域准入与合规豁免】 基于对全球各司法辖区法律环境及网络安全政策的充分尊重，本平台之技术架构、产品分销及业务授权不涵盖中国大陆、伊朗等存在特定网络管制政策的国家或地区。本公司不向上述区域用户主动推广、提供或运维直接接入服务。用户在访问或使用前，应确保其行为已获得属地法律之充分授权；任何违反属地行政准则或法律禁令所产生的合规风险及连带责任，均由用户自行识别并独立承担。
【严禁倒卖】 严禁对在本站购买的 Emby 授权码、订阅账号进行二次转售、加价销售或大规模公开分享。
【内容红线】 严禁利用本公司提供的节点或平台传播、存储政治敏感、色情暴恐或侵害他人版权之非法信息。
【安全义务】 用户须妥善保管授权凭证，任何因用户自行泄露、共用账号导致的封禁，本公司不承担恢复或赔偿责任。

3. 数字化商品无退款政策

重要：鉴于云海互联/云海Mart销售的产品（如全平台订阅、Emby 授权码等）性质属于“即时生效且不可逆”的数字化服务。一旦系统完成发货，其数字权利即被用户激活，无法进行二次回收。因此，除因本公司技术原因导致服务永久性失效外，全线商品均不支持退款、折现或更换。下单即代表您已完成可用性评估并同意此条款。

4. 服务稳定性声明与免责

4.1 本公司致力于保障 99.9% 的服务在线率。但鉴于互联网环境复杂性，对于因骨干网波动、政策干预、上游服务商故障等不可抗力导致的连接延迟或暂时性访问受限，本公司不承担赔偿责任。

4.2 本公司仅作为技术与授权码提供方，用户使用服务的具体行为及后果由用户独立承担。若用户违规使用导致被相关部门追究，本公司将配合相关调取要求并立即终止服务。

5. 协议终止与处罚

对于违反本协议行为（如多IP登录、恶意攻击服务器、非法倒卖等），本公司有权在不发出预警的前提下单方面永久关停相关服务，且不予退还任何剩余费用，并保留向相关部门举报的权利。

6. 隐私与条款变更

本公司尊重用户隐私，相关数据仅用于提供服务优化，绝不向第三方泄露。本公司保留随时修订本条款的权利，更新后的协议在发布之日起即时生效。本协议具有电子合同同等法律效力。
